Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and LighterMind ("we," "us," or "the developer") governing your use of the LighterMind application ("the app") and the LighterMind Pro subscription. By downloading or using the app, you agree to these Terms. This agreement is sometimes referred to by Apple as the End User License Agreement (EULA).

This agreement is between you and LighterMind only, and not with Apple. The developer, not Apple, is solely responsible for the app and its content.

The short version

  • You may use LighterMind on Apple devices you own or control, for your own personal use.
  • LighterMind Pro is an optional auto-renewable subscription that unlocks additional features. The core app is free to use.
  • Subscriptions renew automatically until you cancel. You manage and cancel them in your Apple Account settings.
  • Purchases, billing, and refunds are handled by Apple through the App Store.

License

We grant you a limited, non-transferable, non-exclusive, revocable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where applicable.

You may not copy, modify, reverse-engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent that such restrictions are prohibited by applicable law. You may not distribute, sell, lease, rent, or sublicense the app.

LighterMind Pro subscription

LighterMind Pro is an auto-renewable subscription that unlocks additional features within the app. It is offered in the following plans:

  • LighterMind Pro Monthly — billed every month.
  • LighterMind Pro Annual — billed every year.

The current price for each plan is shown in the app before you purchase and on the App Store. Prices may vary by region and are set in your local currency.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Your subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period.
  • Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the price for the plan you selected.
  • You can manage your subscription and turn off auto-renewal in your Apple Account settings (Settings → your name → Subscriptions) at any time.
  • Deleting the app does not cancel your subscription. You must cancel through your Apple Account settings.
  • If we change the price of a subscription, Apple will notify you, and your consent will be obtained where required before the new price takes effect, in accordance with App Store rules.

If you cancel, you keep access to LighterMind Pro until the end of the current billing period; access does not continue beyond it. LighterMind does not currently offer a free trial.

Restoring purchases

If you reinstall the app or use it on another device signed into the same Apple Account, you can restore an active subscription using "Restore Purchases" in the app.

Refunds

All purchases are processed by Apple. Refund requests are handled by Apple in accordance with the App Store terms. You can request a refund from within the app, in your Apple Account purchase history, or at reportaproblem.apple.com. We are not able to issue refunds directly.

Acceptable use

You are responsible for your own content and for how you use the app. You agree not to use the app for any unlawful purpose or in any way that could damage, disable, or impair the app or interfere with anyone else's use of it.

Your content

You retain all rights to the content you create in LighterMind — your entries, tags, attachments, and other data. As described in our Privacy Policy, your content is stored on your device and, if you use iCloud, in your private iCloud account. We have no access to it.

Maintenance and support

We are solely responsible for providing any maintenance and support for the app, as required under applicable law. Apple has no obligation to furnish any maintenance or support services for the app.

Warranty

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the developer's sole responsibility.

Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law.

Product claims

We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.

Changes to these Terms

If these Terms change, the updated version will be posted here with a new date. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
